These Terms of Service govern the use of the Fidolin service. By registering and using the service, you agree to these terms. Please read these Terms of Service carefully.
1. Scope and Provider
Fidolin is a Software-as-a-Service (SaaS) product for collecting user feedback for websites and web applications. Provider: Manuel Beutel Bergerstraße 12 82024 Taufkirchen, Germany Email: [email protected] These Terms of Service apply to all contracts for the use of the Fidolin service between the provider and the customer (hereinafter "you"). Deviating terms of the customer are not recognized unless the provider expressly agrees to their validity in writing.
2. Contract Formation and Registration
• You must be at least 18 years old or have parental consent to create an account • The contract is concluded upon your registration and our confirmation via email • You are responsible for keeping your login credentials confidential and for the security of your account • All information provided during registration must be truthful and complete • An account is personal and may not be transferred to third parties • For team accounts, the agreed number of users according to the selected plan applies
3. Service Description
Fidolin provides the following digital services: • An embeddable feedback widget for integration on websites and web apps • A web-based dashboard for managing and analyzing user feedback • Automatic capture of screenshots, console logs, and technical browser information • Email notifications for new feedback (depending on plan) • Data export in various formats (depending on plan) The specific scope of services depends on your selected pricing plan. The service descriptions on our website at the time of contract formation are authoritative. We aim for 99.5% availability per month (excluding scheduled maintenance).
4. Pricing, Payment, and Right of Withdrawal
Pricing and Payment: • Prices published on the website at the time of contract formation apply • All prices include German VAT (currently 19%) • Payment is made monthly or annually in advance by credit card or other offered payment methods • Invoices are delivered electronically via email • In case of payment default exceeding 14 days, access to the service may be suspended after reminder Right of Withdrawal for Consumers: If you are a consumer within the meaning of applicable law, you have a statutory right of withdrawal. You may revoke your contractual declaration within 14 days without giving reasons. The period begins upon contract formation. The withdrawal must be submitted in text form (e.g., email) to [email protected]. In case of timely withdrawal, we will refund payments already made within 14 days.
5. Terms of Use and Obligations
You agree to use the service only within the scope of these Terms of Service and applicable law. The following is specifically prohibited: • Use for unlawful purposes or preparation of criminal acts • Collection of special categories of personal data (Art. 9 GDPR) without explicit legal basis • Sending spam, malware, or other harmful content • Attempts to circumvent security measures or overload the system • Resale, sublicensing, or commercial distribution of the service without written permission • Use of automated systems (bots, scrapers) without explicit permission You are responsible for compliance with GDPR when processing feedback data from your end users.
6. Liability and Warranty
Liability: • Fidolin is liable without limitation for damages arising from injury to life, body, or health, as well as for intent and gross negligence • In cases of slight negligence, Fidolin is only liable for breach of essential contractual obligations (cardinal obligations), limited to typical, foreseeable damage • Liability for indirect damages, lost profits, and data loss is excluded in cases of slight negligence • Maximum liability is limited to amounts paid by you in the last 12 months Warranty for Digital Products: The statutory warranty rights for digital products apply to the Fidolin service. We warrant that the service will conform to the agreed requirements during the contract term and will be updated as necessary for contractual use.
7. Contract Term and Termination
• The contract is concluded for an indefinite period and may be terminated by either party at the end of the respective billing period • For monthly payment, the notice period is 14 days to the end of the month • For annual payment, the notice period is 30 days to the end of the contract year • Termination can be made via the dashboard or by email to [email protected] • After contract termination, access remains until the end of the paid period • Fidolin may terminate the contract extraordinarily and without notice in case of serious violations of these Terms of Service • After contract termination, your data will be deleted within 30 days unless legal retention obligations apply
8. Changes to Terms
We reserve the right to change these Terms of Service with effect for the future, insofar as this is necessary due to changes in law, court decisions, changes in market conditions, or comparable reasons and does not unreasonably disadvantage you. We will notify you of material changes by email at least 30 days before they take effect. You have the right to object to the changes within 14 days of receiving the notification. If you do not object in time and continue to use the service after the changes take effect, the new Terms of Service are deemed accepted. We will inform you of this legal consequence in the change notification.
9. Final Provisions
Applicable Law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with habitual residence in the EU, mandatory consumer protection provisions of the country of residence remain unaffected. Place of Jurisdiction: If the customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction is Munich. For consumers, the statutory place of jurisdiction applies. Severability Clause: Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
